WC Student Charged with Assault

Anthony Martino, a senior at Washington College, has been charged with one count of first-degree assault, one count of second-degree assault, and one count of reckless endangerment, after he allegedly struck Daniel Baxter, an off-duty state trooper, right after Baxter identified himself as a police officer.

Martino turned himself in to Chestertown Police on April 2 after fleeing to his home in Media, Pa. where he was apprehended and then released on bail. He has now been released on a $5,000 unsecured bond by a commissioner of the Kent County District Court.

Washington’s Tavern, commonly referred to by its previous name Lulu’s, located at 337 High St, is where Martino is accused of assaulting Baxter on March 22. Pfc. Samuel Kinser, of the Chestertown Police Department, was first to respond.

The fight allegedly ended when Martino threw a punch that knocked Baxter unconscious. Baxter was then airlifted into the Shock Trauma center at the University of Maryland Medical Center. According to court records, Baxter suffered a chipped tooth, but has now returned to work.

Court documents assert that Martino, “created a substantial risk of death or serious physical injury,” towards Baxter.

As recorded by The Chestertown Spy, David Wright, the owner of Washington’s Tavern, said, “the trooper had a greater responsibility to diffuse the situation.”

“It is unfair to either of those gentlemen to make judgment now; that is what the court is for,” said Chief Adrian Baker.

The exact events of the night that led up to the alleged fight are still under extensive investigation by the Chestertown Police Department. Baker said, “We are in search of one thing, and that is the truth.”

Both parties are now represented by attorneys, who were not available for comment. As The Elm went to press Wednesday night a preliminary hearing was scheduled in the Kent County Courthouse on Thursday, April 25.
